Terms of Use (version 2026-09-23)
Last updated:
This is the version of the Terms dated 2026-09-23, kept at a permanent address because orders refer to it. The current Terms are at calven.ai/terms.
These Terms of Use ("Terms") govern access to and use of the Calven service available at app.calven.ai (the "Service"), operated by Calven AI, LLC, a Delaware limited liability company ("Calven", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to it.
If you buy a plan, the plan, price, billing interval, and included volumes shown at checkout and on the Billing page of your workspace form part of these Terms. The Privacy Policy, the Fair Use Policy, and the Data Processing Addendum also form part of these Terms. If you sign an Order Form with Calven, the Order Form and its exhibits prevail over these Terms where they conflict.
1. Eligibility and accounts
The Service is offered to businesses and professionals for business use only, not to consumers. You must provide accurate account information and keep your credentials secure. You are responsible for activity that occurs under your account. Accounts belong to a workspace: workspace administrators can manage members and their access, and your organization is responsible for its members' use of the Service.
If you are in the EU, the UK, or another jurisdiction that gives consumers a statutory right of withdrawal, you confirm that you are acting in the course of your business. To the extent any such right applies anyway, you ask us to start providing the Service immediately and acknowledge that you lose the right of withdrawal once we do.
The Individual plan includes one workspace per company. We may merge or close duplicate workspaces created for the same company.
2. The Service, plans and trials
Calven provides AI agents for product marketing, including competitive intelligence, voice of customer analysis, target audience research, and positioning and messaging. Features may change, be added, or be removed over time, and we do not guarantee uninterrupted availability.
Each plan includes set monthly volumes of products, tracked competitors, and transcripts and documents. The Individual plan also includes a set number of win/loss interviews per month. Enterprise plans can add Expansion Packs. We enforce these limits in the product: anything beyond a limit stays visible but is not processed until you upgrade, add capacity, or the month resets. Nothing is deleted because you reach a limit.
Everything else in the Service, including AI voice interview time, chat with your agents, the Slack app, and the MCP server, is included in your plan subject to our Fair Use Policy, which forms part of these Terms.
New workspaces get a 14-day trial with no payment method required. When the trial ends without a plan, the workspace becomes read-only and is kept as section 13 describes. One trial per company. We may limit or end a trial that we reasonably believe is being used to extract value at scale, to evaluate the Service for a competitor, or by someone who has already trialled it.
3. Your content
You retain all rights to the content you submit to the Service, including uploaded files, documents, transcripts, CRM data, and anything your workspace creates with it ("Content"). You grant Calven a limited license to host, store, process, transmit, and display Content solely to provide and support the Service. Your Content is not used to train foundation AI models. You are responsible for having the necessary rights to the Content you submit.
We keep your Content and other non-public information you give us confidential: we use it only to provide and support the Service, disclose it only to personnel and subprocessors bound by confidentiality obligations, and protect it with at least reasonable care.
If you ask us to help set up or support your workspace, you authorize the Calven team to access it for that purpose until you tell us to stop. That access is limited to your Calven workspace, never to your own systems.
4. AI-generated output
The Service generates output using third-party large language models hosted by our subprocessors, listed at trust.calven.ai. AI output may be inaccurate, incomplete, or outdated. You are responsible for reviewing output before relying on it or sharing it, and for how you use it. The Service does not provide legal, financial, or other professional advice.
Where the Service conducts a voice interview on your behalf, the interview is conducted by an AI agent and the respondent is told so at the start of the call. You agree not to present an AI-conducted interview as a conversation with a person.
5. Integrations and third-party services
You may connect optional third-party services to your workspace. By connecting a service, you authorize Calven to exchange data with it on your behalf. Your use of a third-party service is governed by that service's own terms, and you can disconnect it at any time. The Service also collects publicly available web data (for example, competitor websites) on your behalf; you agree to use these capabilities in compliance with applicable law.
This includes the Calven Slack app and any AI client you connect through the Calven MCP server. Use of the Service through those surfaces counts toward the Fair Use Policy.
6. Acceptable use
You agree not to:
- use the Service for unlawful purposes or in violation of others' rights;
- submit Content you do not have the right to use, including personal data you have no lawful basis to process;
- interfere with or disrupt the Service, or attempt to access another workspace's data;
- reverse engineer the Service or use it to build a competing product;
- resell or sublicense the Service without our written consent.
7. Intellectual property
The Service, its software, and its design are owned by Calven or its licensors. Except for the rights expressly granted in these Terms, no rights in the Service are transferred to you. If you send us feedback or suggestions, we may use them without obligation to you.
8. Publicity and customer references
You grant Calven the right to use your organization's name and logo, and to identify you as a Calven customer, on our website and in our marketing and promotional materials. We will use your logo consistent with any brand guidelines you provide to us.
Customers on our Enterprise plan may withdraw this consent at any time by emailing legal@calven.ai. We will stop using your name and logo in materials we publish going forward, though we are not obliged to recall or amend materials already in circulation. This right to withdraw consent is available only on the Enterprise plan. On all other plans, the rights granted in this section apply for as long as you use the Service.
9. Privacy
Our Privacy Policy explains what personal data we collect and how we handle it. It forms part of these Terms.
Where we process personal data on your behalf, our Data Processing Addendum applies and forms part of these Terms. Our subprocessors are listed at trust.calven.ai. We notify workspace administrators by email before adding a subprocessor that processes your data, as the Data Processing Addendum describes.
10. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be error-free or uninterrupted.
11. Limitation of liability
To the maximum extent permitted by law, Calven will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Calven's total liability arising out of or relating to the Service is limited to the greater of the amounts you paid us in the twelve months before the claim and one hundred US dollars ($100).
12. Indemnification
You will indemnify Calven against third-party claims arising from your Content or your breach of these Terms.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms or where required by law. On written request, we delete or return your Content within 30 days.
We may also suspend or terminate access for non-payment or for a breach of the Fair Use Policy. When a subscription ends, the workspace becomes read-only. We keep it for 90 days, with reminders at 60 and 80 days, then delete it. When a trial ends without a plan, we keep the read-only workspace for 30 days, with reminders at 14 and 23 days, then delete it. Deleted workspaces can be restored on request for 30 days after deletion. Backups age out within 35 days of deletion and are restored only for disaster recovery.
14. Fees, billing and renewal
Fees are set per plan, in US dollars, and shown at checkout. They are billed in advance for the billing interval you choose (monthly or annual) and are exclusive of taxes, which are calculated and added at checkout based on your billing address and tax ID. Stripe processes payments on our behalf; Calven never stores your card details.
Your subscription renews automatically for successive periods of the same length, at the then-current price for your plan, until you cancel. Your payment method is charged at each renewal.
Upgrades and Expansion Packs take effect immediately and are prorated for the rest of the current period. Downgrades take effect at the end of the current period. If a payment fails, we retry it and email you; while a subscription is unpaid, the workspace may become read-only.
We may change prices with at least 30 days' notice by email to workspace administrators. A price change applies from your next renewal after the notice period. Promotional pricing, such as the Startup Program, ends at its stated term and reverts to standard pricing.
15. Cancellation and refunds
You can cancel your subscription at any time from Settings and Billing in your workspace. Cancellation takes effect at the end of the period you have paid for, and you keep full access until then.
Fees already paid are non-refundable, with one exception: if you cancel a self-serve plan within 14 days of your first payment, email support@calven.ai and we refund that payment in full. Disputing a valid charge with your card issuer instead of contacting us may lead to suspension of the workspace.
16. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify you by email or in the Service before it takes effect. For changes that affect fees or plan limits, we notify workspace administrators by email at least 30 days in advance. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
17. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. Disputes will be resolved exclusively in the state or federal courts located in Delaware, and each party consents to their jurisdiction.
